GROUP LED BY KERRY FUNDRAISER WORKS TO ENFORCE NON-EXISTENT AREA OF STATE LAW

An organization claiming to be a non-partisan political do not advocacy group says they are demanding that South Carolina Attorney General Henry McMaster as well as the SC Department of Consumer Affairs shut down all political “robo calls” in the upcoming election.

The National Political Do Not Contact Registry’s CEO and Founder Shaun Dakin (pictured above) said officials are not properly enforcing an existing state law — Section 16-17-446 — and that his organization will “bring the first legitimate complaint under [the law] and stop robocalls in South Carolina in time for the election this November.”

The problem is, that law does not ban all forms of automatically dialed announcing device calls. The statute referenced by Dakin does not specifically outlaw automated messages left on answering machines.

Officials said that those forms which are illegal have been fully enforced and Dakin offered no evidence to the contrary.

Dakin’s personal background also raised concerns over his motivation and the assertion that the group is “non-partisan.” By his own admission, Dakin is a liberal activist who says he raised $240,000 for the presidential campaign of John Kerry in 2004.

When told of this, an insider who asked to remain anonymous said, “His organization can hardly be called non-partisan when it’s CEO raised cash for Kerry-Edwards.”

Dakin’s resume also showed that he worked for Fannie Mae, the collapsed mortgage giant that played a major role in the economic crisis on Wall Street. That company recently received a highly controversial governmental bailout after rampant corruption left it bankrupt.

The NPDNC will make an official announcement Monday, but with no evidence of lax enforcement of the law and no legal ground to stand on for a complete ban on robo calls, it is unlikely Dakin’s efforts will get anywhere.

Thanks for the post. Appreciate the spirited debate.

My most recent op-ed in the Washington Post may be interesting reading on voter privacy rights.

We are non-partisan. In fact, the first politician to take our do not robo call pledge was Rep. Foxx (R-NC).

    Here is the op-ed: http://www.washingtonpost.com/wp-dyn/content/article/2008/09/12/AR2008091202658.html

    Regards,

    Shaun Dakin

Why is the fact that he worked for Fannie Mac relevant at all?
